Lead-based paint and brokerage disclosure forms

Colorado requires several disclosure forms on most residential deals. This article covers the Lead-Based Paint disclosure and the brokerage relationship disclosures, and how Done-Deal fills in the repetitive parts for you.

Lead-Based Paint Disclosure (LBP)

Federal law requires a Lead-Based Paint Disclosure for any property built before 1978. When your transaction has a year-built on file, Done-Deal checks it automatically: if the property was built before 1978, it's flagged as "target housing" and the disclosure requirement is added to your transaction's compliance checklist.

Note: Always confirm the property's actual year built. Done-Deal flags the requirement based on the year-built value on file — if that value is wrong or missing, the flag won't be accurate either.

The brokerage relationship disclosures

Colorado requires you to disclose your working relationship to buyer and seller clients separately:

  • BDB (Brokerage Disclosure to Buyer) — for buyer clients.
  • BDS (Brokerage Disclosure to Seller) — for seller clients.
  • DWR (Definitions of Working Relationships) — explains what each type of working relationship means under Colorado law.

Which one you need depends on which side of the transaction you represent.

What auto-fills

For LBP and the disclosure forms above (plus SPD19 and SFD), Done-Deal pre-fills the fields it already knows from your transaction and property record before you open the form:

  • Property address (and its individual street/city/state/zip parts)
  • Year built
  • Parcel ID and legal description, when on file
  • Seller name

Any field that's already blank gets filled from this data; anything you've already typed in yourself is left alone. Every auto-filled value is tracked so you can see it came from your transaction record rather than something you typed — review it before sending, the same way you'd review any extracted contract field.

FAQ

What if the property's year built is unknown?

Leave it blank rather than guessing. Done-Deal only flags the Lead-Based Paint requirement when a year-built value is present and under 1978 — an unknown year won't trigger a false negative, but it also won't trigger the disclosure automatically. Confirm with your client or public records before closing.

Do I need both BDB and BDS on a transaction?

Only if you're representing both a buyer and a seller in some capacity on the same deal. Most transactions only need the one that matches your side.

Can I edit an auto-filled value if it's wrong?

Yes. Auto-filled values are a starting point, not a lock — click into any field and change it the same way you would any other field. See Filling out a contract.
